When we talk about “Personal Data” in this Privacy Policy, we are talking about Device Information, Order Information, and Information you provide.
This Privacy Policy explains which Personal Data we (Umarex USA, Inc.) collect and how your Personal Data is collected, used, and/or shared when you use any of our Web Sites (listed below) and/or any of our online or mobile products (including any applications, “apps”), hardware (including Axeon Optic Devices), or other services (collectively, “Services”), including when you access the Services through game system platforms or mobile devices. By using the Services you agree to Umarex USA, Inc.’s Privacy Policy and that we, may process, transfer and store your information in the United States. Umarex USA, Inc. To ensure that this Privacy Policy accurately reflects your use of the Services you will need to ensure that you are using the most recent release of any Umarex USA, Inc. software applications.
Personal Data We Collect
Umarex USA, Inc. collects a variety of information that you provide directly to us, including Personal Data that may be contained in videos, comments, or other submissions you upload or post to the Services. “Personal Data” is information that is related to an identified or identifiable natural persona and is protected as Personal Data under applicable data protection laws.
The specific types of information collected will depend upon the Services you use, how you use them, and what you choose to provide, and may include your full name, email address, phone number, product serial number, home address, mobile phone number, credit card information, shipping address, zip code and any other information you willingly provide. The Services may request your Wi-Fi network name and access to your photos and videos to enable you to download photos and videos to your computer/mobile device or upload photos and videos to your social media accounts.
Those who win a prize in our contests may be required to provide identification for age verification purposes, which will only be used for prize fulfillment purposes. When you shop through our Web Sites, we may collect data such as the purchases you have made, items in your shopping cart, and how often you make purchases.
How we collect information you provide
We may collect Personal Data in the following contexts:

Electronic Communications
When you use the Services, or send e-mails and other forms of communications from your desktop, mobile device, game console, or other devices to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages through the Services and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Information We Automatically Collect
When you use the Services that connect to the internet, including, but not limited to, when you access the Services via devices, applications (web, mobile, desktop software, applications, connected TV, or game console), your account, our Web Sites we automatically collect certain information about your device, including information about your web browser, IP address, time zone, browser language, operating system, the state or country from which your device accessed the Services, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time you used the Services, and some of the cookies that are installed on your device. Additionally, as you use the Services, we collect information about the individual products that you view, what Web Sites or search terms referred you to our Web Sites, and information about how you interact with our Web Sites. We refer to this automatically-collected information as “Device Information.”
We may collect Device Information for such purposes as improvement of the Services, troubleshooting, providing the Services, managing the Services, security and monitoring purposes, tracking and analyzing usage, providing content for referring traffic sources and improving overall performance of the Services. Such information includes aggregated user data (which does not allow us to identify you). We also use third party analytics providers and technologies, including cookies and similar tools, to assist in collecting this information, as further disclosed below.
We collect Device Information using the following technologies:

• “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

Additionally, when you make a purchase or attempt to make a purchase through our Web Sites, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”
Device Information
When you connect your Umarex USA, Inc. Device (such as a Axeon camera) to the internet or to a Umarex USA, Inc. software application (discussed below), we may automatically receive certain information about your Device and your use of it, including camera type, serial number, IP address, firmware version, log files, camera modes, settings, durations, error rates, and other similar usage information. This information helps us to improve our Products and Services, troubleshoot bugs, and analyze Device errors.
Mobile Software Applications (App) Information
When you use a Umarex USA, Inc. mobile application (such as the ScopeVue app) we may automatically receive certain information about your mobile device and use of the application, including a mobile device identifier, operating system, version, IP address and other similar information, such as time spent in different portions of the Umarex USA, Inc. mobile application and error rates. We may also collect different types of information about your geolocation, including general information (e.g., IP address, zip code). You can disable the GPS or other location-tracking functions on your mobile device to prevent your device from embedding geolocation data in any content you save or send through your device, provided your mobile device allows you to do this. See your device manufacturer’s instructions for further details.
Information From Other Sources
Umarex USA, Inc. may receive information about you from third parties, such as commerce partners, marketers, social network services, and other parties that we may use to supplement the Personal Data and Device Information that we collect directly from you. If you connect to a third party network (such as a social network), platform, or service through our Services, you are authorizing us to collect, store, and use in accordance with this Privacy Policy any and all information (such as name, email address and location) that you agreed the network or other third party platform could provide to Umarex USA, Inc. based on your settings on the third-party network or platform. You will be asked for your consent when you connect with the third party network, platform, or service via our Services, and/or when you connect with one of our applications through one of these services.
We collect Device Information using the following technologies:
We use Personal Data and Order Information that we collect to communicate with you, fulfill any orders placed through our Web Sites including processing your payment information, arranging for shipping, and providing you with order confirmation, receipts, and/or a shipping confirmation email. We may also send you customer satisfaction emails. If you do not wish to participate in customer satisfaction emails, you may opt-out of such emails upon receipt by clicking the “Unsubscribe” link contained in the email.
Additionally, we use Order Information and Device Information to screen our orders for potential risk or fraud (in particular, your IP address); and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt in data and consent; this information will not be shared with any third parties.
User Account
Based upon the information you provide us at the time of a Umarex USA, Inc. account registration on our Web Sites, we will send you a confirmation email to let you know that your email address was used to register an account or subscribe to an e-newsletter and we will send you an email if you request to reset your user account password.
Postal Address
If you supply us with your postal address you may receive information about our Products and/or Services. Contact us directly by using one of the methods at the bottom of this Privacy Policy if you do not wish to receive information about our Products and/or Services by physical mail.
Telephone Number
Persons who supply us with their telephone number will only receive telephone contact from us with information regarding orders placed or Services requested.
Service-Related Information
We will send you service-related announcements on rare occasions when it is necessary to do so. For example, in the event of a product recall, or if our Service is temporarily suspended, we might send you an email, push notification, or an in application or web-based communication. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your Umarex USA, Inc. account(s).
Email Newsletters
We will occasionally send you emails with information about our Products, Services, special promotions, contests, customer satisfaction surveys, events, and opportunities to interact with Umarex USA, Inc. represented brands and our community. You can sign up to receive these emails and social media campaigns from us on our newsletter sign-up page and/or during checkout while purchasing a product. You have the option to opt-out of these types of communications at any time. Out of respect for your privacy, we present the option NOT to receive these types of communications.
Opting Out
You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send and by opting out of targeted advertising as listed in the Behavioral Advertising section within this policy and by deleting your account associated with our Web Sites and Applications.
Sharing Your Personal Data
Third-Party Service Providers
We share your Personal Data with third parties to help us use your Personal Data. We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service and/or Web Sites is used. These Service Providers use the sort of technology described in the Information We Automatically Collect section above to help us analyze how users use the Services, including by noting the third-party website or platform (such as a social media network) from which you arrive. The information collected by the technology will be disclosed to or collected directly by these Service Providers who use the information to evaluate your use of the Services. We are using an Ecommerce platform to provide our web store, a credit card processing company to bill you for goods and services, third party email service providers, and a digital advertising agency to manage our social media advertising campaigns and Web Sites optimization. When you order products from Umarex USA, Inc. we will share your information as necessary for such third party Service Providers to provide the applicable service to us or on our behalf. These third parties are required to use the information they collect in the course of performing services for us only on our behalf.

Legal Compliance

User-Generated Content
You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin user-generated content. Umarex USA reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.
You may be able to disclose Personal Data about yourself in the course of sharing or submitting content you generate or produce. This includes but is not limited to your uploaded photos or videos and device information. Your photo or video files may also contain your narrations as well as data regarding your geolocation or information from a device if you have chosen to manually associate this data with your photo or video. Any content you submit to Umarex USA, Inc. may be published within promotional advertising along with certain information about you, e.g., your first and last name, state or province of residence or your username that you provided. By submitting or sharing content you generate you agree to the Umarex USA, Inc. Terms of Use.
User Testimonials and Reviews
At times, we may publicly post customer-generated testimonials or submitted product reviews from our Web Sites. You should not include Personal Data into such testimonials and/or reviews and in particular use a "nickname" instead of your real name. By submitting or sharing content you generate you agree to the Umarex USA, Inc. Terms of Use.
Behavioral Advertising
As described in this Privacy Policy, we use your Personal Data to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We do not serve third-party advertisements to you while using our Web Sites; however, we do work with website analytics and advertising partners, including but not limited to Google, Bing, Facebook, and other online advertising networks, to deliver Umarex USA, Inc. advertisements on third party publisher web sites and platforms - these partners may set cookies on your computer's web browser. These cookies allow our partners to recognize your computer so that the ad server can show you Umarex USA, Inc. advertisements elsewhere on the internet, and so that our analytics software can measure your engagement and interactions while using our Web Sites. In this way, ad servers may compile certain information about where you, or others who are using your Device, saw our advertisements, whether or not you interacted with our advertisements, and actions performed on subsequent visits to our Web Sites. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you, and it allows Umarex USA, Inc. to optimize the performance of our advertising campaigns and the usability of our Web Sites. In other words, we use analytics data combined with data about our online ads that have been shown using the Google Display Network or other online advertising networks. YOUR RIGHTS
Umarex USA, Inc. takes reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data. Whenever made possible, you can update your Personal Data directly within the My Account section of the Web Sites. If you are unable to change your Personal Data, please contact us using one of the methods at the bottom of this Privacy Policy to make the required changes.
If you wish to be informed of Personal Data we hold about you and if you want it to be removed from our systems, please contact us using one of the methods at the bottom of this Privacy Policy.
In certain circumstances, you have the right:

• To rectify any Personal Data held about you that is inaccurate.

If you purchase a product but do not wish to receive any additional marketing material from us, you can indicate your preference during check out on our Web Sites by leaving the “Opt-In” checkbox blank and by deleted your Web Sites account.
EU Rights to Personal Data
If you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you request to receive our email communications), or otherwise to pursue our legitimate business interests listed within this policy. Privacy Information for Nevada Residents
We do not sell Personal Data for monetary consideration (as such terms are defined under Nevada law) to a person for that person to license or sell such information to additional persons.

Our Web Sites may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Data Retention
We delete or anonymize your Personal Data as soon as it is no longer required for the purposes we have collected your Personal Data as outlined in this Privacy Policy, unless further processing or storage of your Personal Data is necessary in order to comply with a respective legal obligation or in order to fulfill contracts you have enacted with us (for example if you request to receive our email communications or you elect to store your Peronsal Data within our Web Sites).
Minors
If you are under the age of 18 you may use the Services only with the involvement of a parent or legal guardian. Our Web Sites and Services are not intended for individuals under the age of 13. We do not sell products for purchase by children; however, we may sell products usable by children under adult supervision for purchase by adults. We will not knowingly collect Personal Data about any person under 13 years of age. International Users
Umarex USA, Inc. operates primarily in the United States and as a result, the information we collect may be stored in the United States. By using the Services, you acknowledge and agree that your information may be transferred to, used, processed, or held by Umarex USA, Inc. in the United States and in other countries, including countries outside of your country of residence and used for the purposes set out in this Privacy Policy.
